Service Provision Policy

ARTICLE 1. PURPOSE AND SCOPE
1.1. This Service Provision Policy (hereinafter referred to as the “Policy”) sets out the fundamental principles, processes, and scope of Service by Data Protectify Ltd., Co (hereinafter referred to as “Data Protectify”), for the purposes of:

1.1.1. Ensuring transparency and consistency throughout the Service provision process;
1.1.2. Establishing general principles as a basis for regulating and guiding Service provision activities.

1.2. This Policy should be read and interpreted in each specific case in conjunction with the Service Agreement and/or other relevant agreements (if any) entered into between the parties.
1.3. In the case there is any discrepancy or inconsistency between this Policy and the Service Agreement, the Service Agreement shall prevail.

ARTICLE 2. DEFINITION
2.1. Service means the work and activities provided by Data Protectify to the Client pursuant to the agreement between the parties, including but not limited to consulting, assessment, and implementation support.
2.2. Client means any organization or individual that has a demand for and enters into a Service Agreement with Data Protectify for the use of Service.
2.3. Partner means any organization or individual having a commercial cooperative relationship with Data Protectify, including but not limited to suppliers, professional partners, and subcontractors, who are involved in or support a part of the Service, based on cooperation agreements and confidentiality commitments, in a manner consistent with the agreements entered into with the Client.
2.4. Service Agreement means the agreement between Data Protectify and the Client governing the provision of the Service.

ARTICLE 3. PRINCIPLE OF SERVICE PROVISION
3.1. The Service shall be provided based on expertise in data and technology, with a focus on delivering practical value to the Client and relevant stakeholders.
3.2. Personnel and resources involved in performance of Service shall be allocated with clear responsibilities and flexible coordination mechanisms.
3.3. Data Protectify’s Service provision shall be consistently aligned with its core values and social responsibility, and be conducted in compliance with applicable laws and regulations;
3.4. The Service shall be provided using best efforts, with due care and appropriate skills, in accordance with the nature of the work and the Service Agreement.

ARTICLE 4. CONTENT, SCOPE, AND PROCESS OF SERVICE PROVISION
4.1. Depending on the Service Agreement and specific circumstances, the Service is defined and agreed upon with the Client, in accordance with the business lines and the applicable laws and regulations.
4.2. In all cases, the scope of Service mentioned in Section 4.1 shall not be construed or interpreted as legal services and/or personal data processing services. In addition to the ongoing support throughout the service provision process as described below, Data Protectify recommends that the Client contacts us using the details specified in Article 7 of this Policy in cases further information is required.
4.3. Service provision process:

4.3.1. Receipt of request and proposal: Data Protectify receives the Client’s request and conducts an assessment and discussion to propose an appropriate approach and implementation method.
4.3.2. Signing the Service Agreement: Upon reaching agreement on the proposed content, Data Protectify and the Client sign the Service Agreement, including but not limited to the description of the Service, implementation timeline, and service fees.
4.3.3. Service implementation: The parties, based on goodwill, cooperation, and best efforts, carry out the agreed content in accordance with the Service Agreement and other related agreements (if any).
4.3.4. Deliverable and acceptance: The parties carry out the deliverable and acceptance of the activities performed in accordance with the Service Agreement and other related agreements (if any).
4.3.5. Post-deliverable support: Subject to the scope and duration specified in the Service Agreement, Data Protectify shall use best efforts to coordinate and provide the necessary and appropriate support to the Client.

ARTICLE 5. CONFIDENTIALITY
Data Protectify identifies information confidentiality and personal data protection as one of its top priorities throughout the Service provision process. Based on executed agreements and issued privacy notices, Data Protectify commits to implementing appropriate measures to ensure that information and personal data are kept confidential and secure in accordance with applicable laws and regulations.

ARTICLE 6. LIMITATION OF LIABILITY AND DISCLAIMER
6.1. The provision of Service is based on appropriate approaches and implementation activities and may include interviews and data collection provided by personnel designated by the Client. Accordingly, notwithstanding due care, the Service may still partially depend on the information and materials provided by the Client. Therefore, Data Protectify recommends that the Client contact us for support and clarification in accordance with the Service provision process and the Service Agreement to ensure that the information and materials provided are complete and accurate.
6.2. In accordance with the nature of the Service and subject to the detailed terms of the Service Agreement, the Client shall have full right and obligation to independently decide on the execution, development, or implementation of any recommendations, proposals, and/or other similar outputs resulting from the provision of the Service.

ARTICLE 7. AMENDMENTS, UPDATES, AND CONTACT
7.1. As part of the effort to enhance our service quality and capability, Data Protectify may supplement, amend, or update the contents of this Policy from time to time. Accordingly, Data Protectify shall proactively notify the Client regarding relevant updates through appropriate means and encourages the Client to proactively access Data Protectify’s official website to stay updated.
